Is it possible for me to stop a credit card company wage garnishment?

Question

Is it possible for me to stop a credit card company wage garnishment?

Answer

If you are behind on your credit card payments, your credit card company may have gone to court, and gotten a court order to garnish your wages. In other words, they have been granted access to pull the money you owe them, in small increments over time, directly from your paycheck. Your employer is required by law to comply with a court-ordered wage garnishment.

If you would like to stop the garnished wages credit card companies are taking from you, you need to do one of the following things:

  1. Contact your credit card company immediately to work out some other payment arrangement. You could borrow money and pay the amount due in full, or you can give them an amount up front and sign an agreement to pay some more each month. If the credit card company agrees to a payment arrangement directly, they must inform you, and your employer, in writing and the garnishment should stop.
  2. Contact the court, and consider filing for bankruptcy. Filing for bankruptcy amounts to a stay on all collection activity, including wage garnishments initiated by your credit card company. Filing for bankruptcy has negative implications for your credit rating, so consider this option carefully.

You may also wish to contact a lawyer to help you weigh these and other options to stop wage garnishments. Your lawyer can assist you in choosing the best course of action in light of your particular situation.
