Question:

I'm considering a debt settlement company and a law firm to deal with my debt lawsuit. Which is the better option?

Answer:

If you are facing debt settlement lawsuits or, if no legal action has been taken but you simply want to settle your debt, then you probably already know that you need help. The question is, where do you get that help? Should you talk to a lawyer and hire legal representation or should you work with a debt settlement company? In almost every case, hiring a lawyer is the best answer. There are several reasons why it is almost always better to work with a lawyer:

  • There are much stricter requirements as far as training for lawyers than for debt settlement counselors or debt settlement companies. A  lawyer has to attend law school, where he is trained in negotiation, the rules of the court and lawsuit filings, and all other aspects of the law. There is no such clear cut requirement for a debt settlement counselor or debt settlement firm.
  • Lawyers have to pass the state bar exam to prove their knowledge. While there are programs that accredit debt settlement firms, the requirements for licensing are not nearly as strict as the requirements for becoming a lawyer
  • Attorneys are held to a very strict code of conduct by the American Bar Association and the cannons of their profession. If a lawyer does not comply with the ethical rules that bind attorneys, he can lose his license to practice law. These ethical rules mandate that he charge fair fees, not engage in deceptive advertising, and put his clients best interests first. No corresponding set of rules and ethics binds debt settlement companies to the same extent

Ultimately, a lawyer is your best advocate and your best choice when dealing with debt settlement lawsuits or the process of settling debt.
